Escritura, Property Register & Catastro (Land Register)

A property in Spain must have an Escritura to be legal, and to be registered with the Property Registry and Catastro (Land Registry). In the past it was not necessary to include pool, garage, and outbuildings in the Escritura, but as the property law has now changed, some properties will not now fulfil the legal criteria, and therefore cannot be sold until updated at the Land Registry and / or the Catastro. The cadastral description of real estate shall include its physical, economic and legal characteristics, including location and cadastral reference, surface area, type of land, graphic representation, cadastral value and cadastral titleholder. IBI (Council) Tax

The IBI tax (Impuesto sobre bienes Inmuebles) is a local tax to be paid by the owner of a Spanish property, either annually or every six months to the Town Council where the property is situated. The tax demand is often sent to you through the post and it remains your responsibility to pay it in a given time frame. The most convenient way to deal with payment of the IBI tax is by direct debit through your bank, or visit the local tax office (called SUMA) and pay it directly. The IBI tax receipt is required by law in any property sale, as a proof of payment for the previous years. If you sell your property without having paid this tax, the new owner will become liable for back taxes as well as for fines for late payment.

Topographic Land Survey

A boundary survey establishes the true property corners and property lines of a parcel of land. Boundary surveys are typically performed to obtain building permits, to resolve property disputes, and for erecting fences. Easement lines may also be located, if requested, with this type of survey. Boundary Survey

Boundary Survey is a survey to establish or re-establish the boundaries or limits of a property, can be identified by records commonly referred to as a Boundary Survey. This type of survey will not only identify the location of the boundary, but will also disclose discrepancies that may exist between the recorded description of the property and that of the adjoining properties.

Title Survey

A title survey is the type of survey usually required for a real estate transaction. In this case a new boundary survey is essential.

Residential Plot Survey

Residential Plot Survey is a combination of boundary and topographic surveys for preparation of a site plan, to be used for designing improvements or developments and obtaining local building permits.

Land Survey & Catastro (Land Register) Services

Escritura  & Property Register Services

If you are planning to purchase or sell a property in Spain, we will ensure that the Escritura is registered with the Property Register, and that the Nota Simple report corresponds with what is stated in the Escritura, that it is free of debt and the property belongs to the seller. In case of irregularities in your Escritura, Nota Simple or Catastro, we will do all necessary work involved, to have your property papers brought up-to-date. Another important issue is the IBI (council) tax payment. As the owner of a Spanish property, it is necessary for you to pay your IBI tax, otherwise you will not be able to sell your property, and you will also incur a fine.
